What is a court-recognized business address?

A court-recognized business address is an address you rent and at which you or your company can be reached with legal effect. Letters from authorities, court deliveries and business mail are received there on your behalf. This is required by the Austrian Commercial Register Act (Firmenbuchgesetz); a P.O. box is not sufficient.

Legal significance

A court-recognized address meets the statutory requirements for a registered office. Court summonses and official deliveries are deemed legally served at this address.

Separate private and business

Protect your home address. With a separate business address, your private residence stays out of the commercial register, the imprint and all public records.

Is renting a business address legal in Austria?

Yes. Renting a business address is permitted in Austria. Three criteria matter, and the Postservice.at address meets all three: it is a real physical address, documents can actually be served there, and we confirm the use in writing. What matters is not who owns the property, but that authorities and courts can deliver there.

What this means for your rental agreement: anyone listed in the commercial register must state a business address there, and that is exactly where courts and authorities serve their documents. This is how the Business Service Portal of the Republic of Austria (USP) describes it (retrieved 3 September 2026). A rented address meets this as long as documents can actually be delivered there.

Virtual means: you do not rent your own office, but use an already established address for mail, your imprint and the commercial register entry. The Austrian Commercial Register Act (Firmenbuchgesetz) requires every registered entity to record its seat and the business address relevant for service. A P.O. box or a bare nameplate without delivery capability does not meet that.

The three criteria in detail:

  • A real physical address with street and house number where official mail is actually accepted
  • Written consent from the address holder to use it as a business address, which you can submit to the commercial register court
  • No pure letterbox solution: a P.O. box or a nameplate without delivery capability is not sufficient

Can I register a rented business address as my company seat in the commercial register?

Yes. A rented business address is entered as the business address in the Austrian commercial register. Documents can be served at the Postservice.at address, and we confirm the use in writing. The Commercial Register Act requires a business address relevant for service, not proof of ownership. The seat itself remains a municipality.

Seat and business address are two separate entries. The seat is a municipality, Vienna for example, and is set in the articles of association. The business address is the specific address with street and house number. According to the Business Service Portal of the Republic of Austria (USP), this delivery address is recorded in the commercial register as well, separately from the seat.

What matters is deliverability. The Commercial Register Act lists what has to be recorded and names the seat and the business address relevant for service. Proof of ownership of the property is not among them. Renting an address and sharing it with other companies is therefore permitted. Your rental agreement serves as evidence. Within one business day you receive the address holder's signed consent, and your notary files it with the commercial register application. So the lease comes first, and the founding application already names the Vienna address.

A later change runs through the commercial register court. If the new address stays within the same municipality, the seat does not change and a simplified filing without notarial certification is enough. If the municipality changes, the articles of association have to be amended first and notarial certification is added.
