Section 1 Scope

These General Terms and Conditions (Terms) apply to all service contracts between 1010 Works GmbH, Seitenstettengasse 5/37, 1010 Wien(hereinafter the "Operator") and the user regarding the provision of virtual office services and related services.

Section 2 Subject Matter

On the basis of a valid lease, the Operator is the principal tenant of the business premises at 1010 Vienna, Seitenstettengasse 5/37 and provides virtual office services there. The scope of services depends on the package selected by the user:

Basic: Business and postal address for establishing a legal entity, access to a designated mailbox on site, company sign
Plus: Additionally scanning and digital forwarding of mail, mail forwarding within Austria, parcel acceptance
Premium: Additionally forwarding of mail, collection of RSb registered mail with power of attorney, mail forwarding worldwide, company sign

Section 3 Conclusion of Contract

The contract is concluded through the user's order and its acceptance by the Operator. Acceptance takes place by confirmation via email and activation of the service. Each user receives an individual service contract.

Section 4 Prices and Payment

The current prices can be viewed on the Operator's website. All prices are exclusive of 20% value added tax. The fee is payable in advance for the respective billing period (monthly or annually). Processing is handled via the payment service provider Chargebee.

Section 5 Term and Termination

The contractual relationship is concluded for an indefinite period. Both parties may terminate it in writing on a monthly basis without giving reasons. In the case of annual payment, the notice period is one month to the end of the respective contract year.

The right to extraordinary termination for good cause remains unaffected.

Section 6 Right of Withdrawal

Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day on which the contract was concluded.

Section 7 Obligations of the User

The user undertakes:

To provide only truthful information
Not to use the business address for unlawful purposes
To notify any changes to contact details without delay
To collect mail at regular intervals, provided a mailbox has been assigned on site
To comply with any house rules that may exist for the property

Section 8 Liability

The Operator is liable without limitation for intent and gross negligence. For slight negligence, the Operator is liable only in the event of a breach of material contractual obligations. Beyond this, the Operator assumes no liability whatsoever for the delivery of mail items.

The user is liable to the Operator for all damage resulting from improper handling or use of the premises not in accordance with the contract, caused by the user or the user's visitors.

Section 9 Data Protection

The Operator processes the user's personal data in accordance with the General Data Protection Regulation (GDPR). For details, please refer to our privacy policy.

Section 10 Final Provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Vienna, provided the user is an entrepreneur.

Apart from the respective service contract, there are no verbal side agreements. Amendments or additions must be made in writing.

Should individual provisions of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected thereby. The invalid or unenforceable provision shall be replaced by a permissible provision that comes as close as possible to it in economic terms.
