Business Address
A business address is the official address of a company in Austria. It must be capable of receiving service of documents, that is, a genuine address located in Austria at which authorities and courts can serve documents with legal effect. In the Austrian commercial register (Firmenbuch) it is recorded as the business address relevant for service of documents. A mere post office box is not sufficient.
Explanation
The business address is a company's central external point of contact. It appears on business documents, invoices, the imprint and in public registers. Unlike the private address, it serves exclusively business purposes. For companies subject to registration it is, under the Austrian Commercial Register Act (Firmenbuchgesetz), the business address relevant for service of documents; the legal effect of service follows the Austrian Service of Documents Act (Zustellgesetz), which also covers RSa and RSb letters. Post office boxes are not permitted as a business address. The choice of business address affects the place of jurisdiction, the competent tax office and the competent trade authority. Only Austrian law as published in the Austrian Legal Information System (RIS) applies, not German commercial register or civil procedure law.
